Pure₂O Terms & Conditions
Supply, Installation & Warranty
1. Definitions
"Pure₂O" means Pure₂O Pty Ltd (ABN 33 691 392 462), its employees, contractors, subcontractors, agents and authorised representatives.
"Customer" means the person, company or entity purchasing Goods and/or Services from Pure₂O.
"Goods" means any filtration system, filter cartridge, cover, component, fitting, accessory or product supplied by Pure₂O.
"Services" means installation, delivery, plumbing works, excavation, trenching, concrete cutting, commissioning, maintenance, repairs or any related services supplied by Pure₂O.
"Agreement" means any accepted quotation, invoice, order, online purchase, deposit payment or booking incorporating these Terms and Conditions.
2. Acceptance
By accepting a quotation, paying a deposit, purchasing Goods, booking an installation or otherwise engaging Pure₂O, the Customer agrees to be bound by these Terms and Conditions.
Any variation to these Terms must be agreed to in writing by Pure₂O.
Pure₂O may engage licensed plumbers, contractors and subcontractors to perform Services on its behalf.
3. Pricing & Payment
All prices are in Australian Dollars and include GST unless otherwise stated.
Pure₂O may require a deposit before materials are ordered or installation is scheduled.
The balance of payment is due immediately upon completion of installation unless otherwise agreed in writing.
Ownership of Goods remains with Pure₂O until all amounts owing have been paid in full.
Pure₂O reserves the right to charge reasonable recovery costs, collection fees, legal costs and interest on overdue accounts.
4. Quotations & Variations
Quotations are based on information available at the time of quoting.
Additional charges may apply where unforeseen site conditions are encountered, including but not limited to:
• Additional trenching
• Rock or limestone excavation
• Tree roots
• Buried obstructions
• Concrete cutting
• Paver lifting and reinstatement
• Roof space works
• Restricted access
• Reticulation modifications
• Water pressure compliance works
• Additional pipework or fittings
• Relocation of services
Where additional works are required, Pure₂O will advise the Customer and seek approval before proceeding wherever reasonably practical.
If required works are declined by the Customer and those works are necessary to complete the installation safely or compliantly, Pure₂O may suspend or cancel the installation and recover reasonable costs incurred.
5. Delivery & Installation
Installation dates and delivery timeframes are estimates only.
Pure₂O is not liable for delays caused by weather, supplier shortages, site access restrictions, customer delays, council requirements or events outside its reasonable control.
The Customer must provide safe, unobstructed access to the installation area.
Additional charges may apply where installation is delayed due to restricted access, locked gates, excessive vegetation, animals, stored materials, construction works or other site obstacles.
6. Water Pressure & Flow
The Customer acknowledges that incoming water pressure and flow rates are outside the control of Pure₂O.
The installation of a whole-house filtration system may result in a reduction in pressure and/or flow rate. The extent of any reduction depends on incoming water pressure, plumbing design, pipe sizing, water demand, filter condition and existing plumbing infrastructure.
Pure₂O does not guarantee any specific pressure or flow rate following installation.
Where incoming water pressure is below recommended levels, Pure₂O accepts no liability for reduced pressure, reduced flow or customer dissatisfaction following installation.
Where incoming water pressure exceeds 500kPa, Pure₂O may recommend the installation of a Pressure Limiting Valve (PLV/PRV).
If the Customer declines the installation of a recommended PLV/PRV, Pure₂O accepts no liability for leaks, bursts, water hammer, housing damage, plumbing failures, appliance damage, pipe failures or any loss arising from excessive water pressure.
Damage arising from excessive water pressure may not be covered under warranty.
7. Warranty
Pure₂O filtration systems include a 10-year limited warranty on filter housings, brackets and structural components, subject to normal residential use and compliance with these Terms.
This warranty applies in addition to the Customer's rights under Australian Consumer Law.
Filter cartridges, consumables, O-rings, lubricants, seals and wear items are excluded from warranty coverage.
To maintain warranty coverage, filter cartridges must be replaced at intervals not exceeding 12 months, or sooner where required by water quality, usage levels or operating conditions.
Warranty does not cover damage caused by:
• Failure to maintain the system
• Failure to replace filters
• Excessive water pressure
• Water hammer
• Misuse or neglect
• Freezing
• Fire
• Flooding
• Vandalism
• Unauthorised modifications
• Chemical contamination
• Improper use
Warranty claims must be submitted with proof of purchase and photographs of the issue.
8. Filtration Performance
The Customer acknowledges that filtration performance varies depending on source water quality and household usage.
No filtration system can guarantee the removal of every contaminant, chemical, mineral, pathogen or substance present in water.
Pure₂O makes no guarantee regarding specific health outcomes, medical outcomes or individual customer experiences.
Whole-house filtration coverage is dependent upon the property's existing plumbing configuration.
Pure₂O cannot guarantee that every outlet, appliance, external tap, outbuilding, irrigation system, granny flat, workshop or secondary structure is supplied by filtered water unless specifically confirmed during installation.
9. Excavation, Paving & Surface Reinstatement
Installation may require excavation, trenching, drilling, concrete cutting, paver lifting, landscaping disturbance or surface reinstatement.
Pure₂O will take reasonable care when performing such works but does not warrant that reinstated surfaces will match existing surfaces in appearance, colour, finish, texture, level, compaction, drainage or performance.
No warranty or guarantee is provided for:
• Paver lifting
• Paver reinstatement
• Concrete cutting
• Concrete reinstatement
• Excavation
• Trenching
• Landscaping
• Lawn repairs
• Garden beds
• Decorative stone
• Artificial turf
• Irrigation systems
• Reticulation systems
• Surface finishes
Where pavers are removed from driveways, vehicle crossovers, parking areas or other load-bearing surfaces, Pure₂O accepts no responsibility for future movement, sinking, rutting, cracking, settlement, separation or unevenness.
Professional compaction and reinstatement by a paving contractor may be required.
Ground movement, subsidence, settlement, erosion, drainage changes and soil movement are natural processes outside the control of Pure₂O and are specifically excluded from warranty.
Any rectification works performed by Pure₂O are undertaken on a best-efforts basis only and are not intended to restore surfaces to original builder, concreter, landscaper or paving contractor standards.
10. Existing Plumbing & Underground Services
Pure₂O is not responsible for pre-existing plumbing defects, leaks, corrosion, deteriorated pipework, faulty fittings, poor workmanship, non-compliant plumbing or existing water pressure issues.
Installation works may expose existing defects that were previously unknown.
Pure₂O accepts no liability for failures occurring in existing plumbing systems following installation where those failures arise from pre-existing conditions.
The Customer is responsible for identifying and disclosing known underground services prior to commencement of works.
Pure₂O accepts no liability for damage to concealed underground services that are not reasonably identifiable prior to excavation, including:
• Irrigation lines
• Drainage lines
• Telecommunications infrastructure
• Electrical cables
• Gas lines
• Conduits
• Water services
11. Cancellation
Customers cancelling after materials have been ordered or installation has been scheduled may incur reasonable administration, labour, travel and material costs.
If cancellation occurs after work has commenced, the Customer is responsible for all costs incurred up to the cancellation date.
Pure₂O may cancel an installation where site conditions prevent safe or compliant completion of works.
12. Limitation of Liability
To the maximum extent permitted by law, Pure₂O's liability is limited to the repair, replacement or refund of the Goods or Services supplied.
Pure₂O shall not be liable for indirect, incidental, special, consequential or economic loss including but not limited to:
• Loss of profits
• Loss of business
• Loss of opportunity
• Accommodation costs
• Water damage
• Property damage not directly caused by Pure₂O negligence
• Replacement of third-party property
• Business interruption
Pure₂O's total liability shall not exceed the amount paid by the Customer for the Goods and Services giving rise to the claim.
13. Cooling-Off Rights
Cooling-off rights only apply where required by Australian Consumer Law.
Online purchases made voluntarily by the Customer are generally not subject to cooling-off provisions unless otherwise required by law.
14. General
These Terms are governed by the laws of Western Australia.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Failure by Pure₂O to enforce any right or provision under these Terms shall not constitute a waiver of that right.
These Terms constitute the entire agreement between Pure₂O and the Customer unless otherwise agreed in writing.
