TERMS & CONDITIONS – SUPPLY, INSTALLATION & WARRANTY
1. Definitions
Company means Pure₂O Pty Ltd (ABN 33 691 392 462) and its authorised agents.
Customer means the person or entity purchasing the Goods or Services.
Goods means the water filtration systems, components, and accessories supplied by the Company.
Services means installation, delivery, or related work performed by the Company or its contractors.
Agreement means the online order, invoice, or written acceptance incorporating these Terms.
2. Acceptance
By placing an order through the Company’s website, paying a deposit, or booking an installation, the Customer agrees to these Terms and Conditions. Any variations must be in writing and accepted by the Company.
The Company may use licensed independent installers. While the Company engages qualified professionals, workmanship issues should initially be directed to the installer who performed the work.
3. Price & Payment
All prices are in Australian dollars and include GST unless stated otherwise. A deposit may be required before installation is scheduled. The balance is due on the day of installation, unless otherwise agreed.
Payment methods include EFT, cash, or approved card (merchant surcharges may apply).
Ownership of the Goods does not transfer to the Customer until full payment has been received.
4. Delivery & Installation
Any delivery or installation timeframes provided are estimates only. Delays caused by weather, supply shortages, access restrictions, or circumstances outside the Company’s control do not constitute a breach of Agreement.
The Customer must ensure clear, safe access to the installation site and confirm that existing plumbing and electrical services are suitable. If unsafe or unsuitable conditions exist, installation may be rescheduled until they are rectified.
5. Cooling-Off (Unsolicited Sales Only)
For online purchases, general consumer cooling-off laws do not automatically apply.
However, if the Customer purchased as a result of an unsolicited approach (e.g., door-to-door sale), a 10-business-day cooling-off period may apply under Australian Consumer Law.
Online purchases made voluntarily by the Customer without unsolicited contact are not covered by this cooling-off period.
6. Warranty
Pure₂O systems include a 10-year limited warranty on system housings and structural components, subject to correct installation, proper maintenance, and normal residential use.
Filters, cartridges, and consumables are not covered as they are wear items.
To lodge a warranty claim, Customers must contact the Company at info@pure2o.com.au and provide proof of purchase and photos of the claimed issue.
This warranty operates in addition to the Customer’s rights under the Australian Consumer Law, which entitles Customers to repair, replacement, or refund in the case of a major failure.
7. Customer Acknowledgements
The Customer acknowledges that:
• Filtration performance varies depending on local water quality and household usage.
• No filtration system can guarantee the removal of every possible contaminant.
• Routine maintenance and filter replacement are essential to maintain system performance.
• The Company is not responsible for damage caused by poor incoming water quality, misuse, neglect, unauthorised alteration, or failure to carry out required maintenance.
8. Cancellation
Customers cancelling after installation has been booked may incur reasonable costs for materials ordered, labour scheduling, or travel arrangements.
If the Customer cancels on the day of installation or after work has begun, they are responsible for costs incurred up to that point.
The Company may cancel an order and issue a refund if installation cannot be completed due to factors outside its control.
9. Limitation of Liability
To the maximum extent permitted by law, the Company’s liability is limited to the repair or replacement of the Goods, or the amount paid for them.
The Company is not liable for indirect or consequential loss, including loss of profit, loss of opportunity, or damage caused by improper use or failure to maintain the system.
10. General
These Terms are governed by the laws of Western Australia.
If any clause is found invalid or unenforceable, the remaining clauses continue in full effect.
Failure by the Company to enforce any right or provision does not constitute a waiver.
